New Delhi, December 12: Fifty Rajya Sabha members who have signed a memorandum for impeachment of Karnataka High Court Chief Justice PD Dinakaran for his alleged involvement in land grabbing and corruption, will submit the same to Vice-President Hamid Ansari, who is also the Chairman of Rajya Sabha, on December 14.
For initiating impeachment proceedings against a sitting High Court or Supreme Court judge, the memorandum must be signed either by 50 Rajya Sabha members or 100 Lok Sabha members. Fifty BJP and Left MPs have already signed the memorandum forimpeachment of Justice Dinakaran.
The Supreme Court collegium headed by Chief Justice of India KG Balakrishnan is yet to take a final decision on the issue of elevation of Justice Dinakaran to Supreme Court.
The Union Law Ministry has already rejected the August 28 recommendation of the collegium forwarding the name of Justice Dinakaran to the Supreme Court.
The collegium could not meet on last Wednesday because Justice Balakrishnan was hospitalised and the meeting of the collegium is likely to take place anytime now to decide the fate of Justice Dinakaran.
The Rajya Sabha has already initiated impeachment proceeding against another High Court judge of Kolkata Justice Soumitra Sen who is also facing allegations of misappropriation of funds when he was a lawyer.
Impeachment of Justice Sen was recommended by CJI Balakrishnan to Prime Minister Manmohan Singh in August this year.
A committee headed by sitting Supreme Court judge Justice B Sudershan Reddy is already conducting an inquiry against Justice Sen who had refused to take voluntary retirement.
