Plea challenging Assembly Speaker’s action dismissed

A division bench of the AP High Court comprising Chief Justice Nissar Ahmed Kukru and Justice PV Sanjay Kumar on Thursday dismissed a public interest writ petition challenging the action of the State Assembly Speaker N Kirankumar Reddy in not accepting the enmasse resignation of MLAs.

K Parthasarathy Reddy, a practising lawyer, questioned the action of the Speaker in keeping with him the resignation of MLAs made in connection with the demand for a separate state. The bench accepted the argument of the Advocate General DV Seethrammurthy that the question is best left to the wisdom of the Speaker and the matter could not be decided in a writ petition under the guise of a public interest writ petition. In another case, Justice VVS Rao of the AP High Court on Thursday dismissed a writ petition filed by Yeranani Kusuma challenging an order placing her under suspension.

She challenged the order of the District Collector as being contrary to law and without jurisdiction. Special government pleader Sridhar Reddy pointed out that the government had both the material and the power to make the order.

It is the case of the government that the erring sarpanch of the Kodad Gram Panchayat had granted permission of layouts without the authority of law and had acted contrary to public interest.
