Ex-AG condemns AP HC remarks against Srikrishna report on Telangana

New Delhi, February 27: Former Attorney General of India Soli Sorabjee has disapproved the intemperate remark reportedly made by Andhra Pradesh High Court criticising Justice B N Srikrishna report on Telangana describing it ”a tissue of lies”.

Mr Sorabjee has cautioned the judiciary, including Supreme Court and High Court judges, to exercise restraints while hearing the cases.

The remark were reportedly made by a single judge bench of the Andhra Pradesh High Court, who is hearing a PIL on Telengana issue.

The High Court judge flared up when he was shown some parts of the reports.

Mr Sorabjee, in his blog, has said, ”If that be true, the judicial conduct is highly regretable and betrays lack of judicial restraints and decorum. I understand that the Union Government is taking appropriate proceedings in the matter. Judges should realise that sitting up on the bench doesn’t give them a licence to indulge in intemperate tirades in general and which are not warranted or occasioned by the facts of a particular case before them. The urge to make media headline must be eschewed.” He said, ”And what applies to High Court judges should also apply equally or rather with greater force to judges of the Supreme Court. Noblesse Oblige.” Mr Sorabjee also criticised the sweeping remarks reportedly made by some Punjab and Haryana High Court judges describing real estate developers and builders as theives and fraudesters who are looting the nation.

He said, ”If my information is correct, such judicial conduct is thoroughly unacceptable because it destroys litigant’s confidence in fair and unbiased administration of justice.” Recently, an apex court bench comprising Justices B Sudarshan Reddy and S S Nijjar also disapproved the disparaging remarks made by Andhra Pradesh High Court bench against government advocates and court staff.
