‘Consumer Forum can hear cases against realtors’

Hyderabad, August 14: A division bench of the AP High Court comprising Justice G Raghuram and Justice Naushad Ali on Friday declared that the State Consumer Forum had the power and jurisdiction to entertain cases against realtors not executing sale deeds.

The bench dismissed a batch of 19 writ petitions filed by Ms Narne Estates. “A scheme which promotes sale of immovable property coupled with development obligates the promoter not only to develop the property but also convey the title to the purchaser.

The conveying title becomes an integral part of the agreement and it cannot be held that only the civil court has the power to entertain the litigation, the judge said.

Speaking for the bench, Justice Naushad Ali said that the powers under the Consumers Protection Act are not in derogation to the powers under the general law and a wide interpretation is to be given. The bench refused to go into the various factual allegations while dismissing the writ petition on the question of jurisdiction.

Court asks for original minutes book of TTD

A division bench of the AP High Court comprising Justice Prakash Rao and Justice Reddy Kanta Rao on Friday summoned the original minutes book of the TTD.

The bench is hearing a batch of writ petitions questioning the project of covering the main temple with gold. It may be recalled that various petitions including one filed by Janata MP Subrahmanya Swamy challenged the gold plating project.

In a separate development, the bench of G Raghuram and Justice Ramesh Ranganathan heard inconclusively arguments on the power of the government to order an enquiry into the dollar scam.

The bench also sought details of the Archita seva scam. The bench questioned the TTD on how it supervised the sale of Archita seva tickets and prioritise VIP darshan.
