Builder cheats property owner, gets 3 year in jail

Hyderabad, October 06: A Nampally court sentenced the proprietor of a construction firm and her husband to three years simple imprisonment for misappropriating the property of a doctor misusing the General Power of Attorney given to them at the time of signing an agreement. The III Additional Chief Metropolitan Magistrate recently sentenced Ch. Niveditha Reddy of Nischint Constructions and her husband Baba Prasada Reddy after finding them guilty under section 406 (criminal breach of trust) of the Indian Penal Code.

Dr P.S.N. Murthy complained to the court that he had entrusted his property, Ashwood Villa in Banjara Hills, to Nischint Constructions for development and building ground + two floors within a period of one year after signing the agreement in May 1993. The doctor said that in violation of the agreement, the builder disposed part of the property to seven persons in January 1994, keeping him in the dark. Besides this, the builder failed to complete the construction even after 18 years, the property owner told the court. The doctor further said that the builder dishonestly misappropriated the property by misusing the General Power of Attorney given to the builder at the time of signing the agreement in May 1993, putting him and his family to untold miseries.
