New Delhi, January 17: A petition was filed today in a court here seeking registration of a case against Congress leaders Rahul Gandhi and Digvijay Singh alleging they had hurt religious sentiments by raking up the Batla House encounter issue.
The petition was filed by one Jitendra Singh in the court of Chief Judicial Magistrate V K Singh, his counsel Lal Bahadur Singh said.
The petitioner stated during Rahul’s Azamgarh visit on January 10 the issue of Batla House encounter was raised by Dijvijay Singh who had termed it fake.
This action had hurt religious feelings, the petitioner said adding as the matter was pending in a court such remarks were unfortunate.
The CJM fixed February eight for further hearing.
The petitioner’s counsel said though Digvijay Singh had given the statement, Rahul had not contradicted it showing his involvement in the episode.
He said the court had been requested to order filing of a case againt them under section 296 A (disturbing religious assembly) and section 298 (uttering words with deliberate intent to hurt religious feelings) of the IPC.
Digvijay had said in Azamgarh that he always believed that the Batla House encounter was “fake”.
The encounter on September 19, 2008 at Batla House in the national capital led to the killing of Delhi Police Inspector Mohan Chandra Sharma and two terrorists.
