A youth has been acquitted by a Delhi court of the charges of kidnapping and raping a minor girl as the investigating officer failed to locate the place where the alleged crime was committed. Additional Sessions Judge J R Aryan let off North East Delhi resident Firoz saying the prosecution’s story was “doubtful”. “It was difficult to believe and accept mere testimony of the girl that the accused had the sexual intercourse with her without her consent,” the court said. Noting the absence of resistance on the part of the girl to the act of sexual assault, the court added the girl was confined in a room for three days but the investigating officer could not locate the place. According to the prosecution, Firoz had kidnapped the 15-year-old girl from Sunder Nagri in North East Delhi to force her into an illicit intercourse in September 2011. It said the accused had confined the girl in a house for three days and had repeatedly raped her. The case was registered by the girl’s family. She was later rescued by the police and the accused was arrested. The girl had deposed in the court that on the day of incident, when she was on her way to fetch milk, the accused came to her and put something on her face after which she lost consciousness. On regaining consciousness, she found herself confined in a room, she added. The accused, in his defence, said he was being forced by the girl’s sister to marry her and when he refused, he was falsely implicated in the rape case. PTI
