Lucknow: In a move to shield the perpetrators, the Yogi Government decided to withdraw rape and abduction case against former Home Minister Swami Chinamayanand a three-time BJP MP.
The complaint was filed by a girl from his Ashram who had leveled rape charges against Swami Chinamayanand in November 2011 with the Shahjahanpur Police, TOI reports.
The victim alleged that she was confined to an ashram in Haridwar and was raped by the former minister. She also said Chinayamanand had threatened her with dire consequences if she chose to file a complaint against him.
The victim’s father had then lodged an FIR against him at Kotwali police station in Shahjahanpur.
However, the former Minister moved the high court seeking a stay on his arrest. Ever since the case has been pending and now the Yogi Government has decided to withdraw the case against him.
According to an accessed copy of withdrawal of the case from the prosecution officer, stated: “The administration has decided to withdraw the case as per the section 321 of the CrPC and the public prosecutor is requested to submit this application before the court.”
No legal reason has been cited in the letter except only section 321 of CrPC is mentioned which allows a government lawyer to, with the consent of the court, withdraw from a prosecution.
Swami Chinamayananand was appointed as the MoS for internal security in Atal Bihari Vajpayee government.
