New Delhi: What can be termed as a rare case, a 35-year-old married woman approached family court expressing her wish to have a second child with her estranged husband who has already filed for divorce.
The married women from Maharahstra pleaded before the family court for conceiving a second child with her husband through restoration of conjugal relations or in-vitro fertilisation before her biological clock times out, News18 reports.
The couple already has a child from their marriage but her husband has filed for divorce alleging cruelty by her in 2017 and she approached a court in Nanded for restitution.
The judge hearing the case observed that though the issue of reproductive rights is “emotionally debatable and gender intricate” it held the woman has the right to reproduce and exercise her rights but acknowledge that law has limits.
Holding her request, the judge directed the husband to donate his sperms for artificial insemination.
But for Assisted Reproductive Technology, husband’s consent is crucial. The husband is said to have opposed the plea stating it as illegal and against norms.
