(Siasat News)A.P. State Wakf Board will soon file its counter affidavit in Supreme Court of India in Dargah Husain Shah Wali wakf property situated in Manikinda Jagir.
Wakf Board has already made initial preparations of counter affidavit.
Wakf Board has decided to acquire the services of the noted lawyers of Supreme Court for pleading this case.
A meeting of the committee constituted by Wakf Board was held yesterday under the chairmanship of Maulana Syed Ghulam Afzal Biyabani. Various legal aspects of the case were considered in the meeting.
Noted lawyer, Mr. Shafeequr Rahman Mohajir, Advocate and the Standing Consul of Wakf Board, Mr. Masood Ali Khan attended the meeting. Various clauses of the counter affidavit to be filed in Supreme Court were discussed in the meeting. The strategy likely to be adopted by the opponent party was also discussed. The counter affidavit drafted by Mr. Shafeeq Mohajir would be sent to Supreme Court lawyers for finalizing it.
It was also known that the Board decided to remove apprehensions in the minds of the public that it has taken a lenient stand in this case, which facilitated the opponent party to take advantage of it.
The Board also noted that a misunderstanding is being created that Board has consented to accept compensation of these wakf properties. It was, therefore, decided to instruct the Supreme Court lawyers not to give consent to accept compensation of these properties but to maintain the stand taken in A.P. High Court that the Govt. should take back the land from the allot tees or should get it evacuated, otherwise they should accept to be the tenants of Wakf Board. The cost of construction on these properties would be repaid by mortgaging these properties. The proposal of ‘ land for land’ would be accepted only when the market value of the alternate land is equal to the value of these properties not in terms of the area of the land but the structures and the amenities on these lands.
