Hyderabad, July 26: Wakf Amendment Bill was passed hurriedly & deliberately on a Friday when Muslim members of the Parliament had gone for offering Namaz.
Muslim members did not get an opportunity to point out the mistakes contained in the bill. After the bill was passed in the Parliament, it was sent to a Select Committee for re-consideration. A consultative meeting of the Muslim intellectuals was convened at Maulana Azad Oriental Research Institute, Public Garden to consider the amendments in the wakf bill.
Mr. Hamid Mohammed Khan, President of Movement for Peace and Justice said according to the report submitted by Justice Sachar Committee , all the non registered properties should be treated as Wakf Properties but in the proposed bill, only registered properties have been taken into account.
He demanded the Govt. to treat both the registered and the non-registered properties as Wakf properties. In the proposed bill, the right to approach the court has been given only to the Mutawalli (Custodian) of Wakf property where as Wakf Boards are responsible for the maintanance of all the wakf properties.
He demanded that any Muslim should be given the right to approach the ocurt of law for redressal. In case. If a Wakf property is given to any developer, he gets 76% of the share and the remaining 24% of the share will be given to Wakf Board. This proportion should be reversed. Wakf Board should get 70% and the developer only 30%. Wakf Board should have executive and juidicial powers. Political interferance should be stopped because the unnecessary advice tendered by the politicians creates problems. He also suggested that whatever amendments Muslim Personal Law Board has made, should be accepted. He demanded the Govt. to sanction Rs. 10 thousand crore for strengthening the financial position of the Wakf Board so that it can take legal action against those who have occupied Wakf properties illegally.
At the end of his speech, he requested the ulema and other intellectuals of the Muslim Community to formulate guidelines regarding the use of Wakf properties given on lease against the will of the persons who donated these properties.
He told that a ‘dharna’ programme will be arranged on 5th September 2011 in front of the Parliament to exert pressure on the members of the Select Committee to incorporate the amendments proposed by the Muslims.
