Hyderabad: Who is responsible for the failure of Wakf cases in courts? Chairman of Telangana State Wakf Board, Mr. Mohammed Saleem is making an attempt to find out the reply to this question by consulting legal experts.
It is observed that quite often, despite producing the relevant wakf records, the judgments are against Wakf Board. This situation could be attributed to lack of competent legal experts, non-cooperation of Wakf Board officials and lack of pleading the cases properly by its advocates.
A review of the past court cases reveals that since 2014, 15 cases were filed in High Court but very few cases were resolved and still there are many cases which are pending. The Standing Consul of Wakf Board and the Legal Dept. did not show any interest in settling these cases.
To quote an example of the lethargy of the Wakf Board staff, the case of taking over the management of Anwar-ul-Uloom College could be cited. Wakf Board passed a resolution earlier to take over the management of Anwar-ul-Uloom College but the legal department of Wakf Board did not take any further action in this regard.
It is also reported that in some cases, Standing Consul of Wakf Board struck a deal secretly with the other party resulting in huge losses to Wakf Board. It was noticed that such legal experts were selected for pursuing Wakf Board cases whose success record is very less.
In Manikonda Jagir and other cases, the arguments of the Wakf pleaders did not benefit the Wakf Board. The case pertaining to Anwar-ul-Uloom Colleges was also entrusted to the same pleader without consulting either the CEO or the chairman of Wakf Board.
Mr. Mohammed Saleem, Chairman of Wakf Board has decided to change the legal team of Wakf Board completely. A team consisting of noted advocates is being prepared. It is reported that so far, five advocates have given their consent. Although, the fees of these legal experts is in lakhs of rupees but the success record of their cases is associated with their names.
The chairman also indicated that Wakf Board is prepared to pay huge fees to these lawyers in order to save wakf properties worth crores of rupees. He further informed that with the continuous failure of court cases, Wakf Board is facing difficulties. He expressed his surprise that despite proper wakf records, the court judgments are not in favour of Wakf Board which clearly indicates that Wakf Board pleaders failed to convince the judges and also to establish the ownership of wakf properties through documents.
It may be mentioned that the next hearing of Anwar-ul-Uloom College case is scheduled for 8th August.
