Shimla: Two BJP leaders were reportedly suspended after a video showing them in compromising position went viral on social media.
According to sources, two BJP party leader’s associated with the party’s youth wing Bharatiya Janata Yuva Morcha (BJYM) in Kullu district was caught in the act in a 12.35 minute video reportedly shot by themselves, India today reports.
A case of registered by the Himachal Pradesh this Saturday under the Information Technology Act warning people against sharing the video.
Sources suspect the video was sent by the woman to the suspended BJYM leader on WhatsApp in February.
The suspended husband’s wife too got her hands on the video. An audiotape of the wife’s 13.05-minute conversation with the woman involved in the case where the wife demands the woman stays away her husband was also released.
The two leaders have been suspended said the state BJP vice president Ganesh Dutt.
An FIR was registered under sections 67 (punishment for publishing or transmitting obscene material in electronic form) and 67 A (punishment for publishing or transmitting of material containing sexually explicit act in electronic form) of Information Technology Act, 2000 on Saturday after the woman seen in the video moved the police said Kullu Superintendent of Police Gaurav Singh.
The district police chief has warned social media users against sharing the video or photos of the incident.
“Appropriate legal action will be taken against those who have already shared it, will share it in the future or will keep it,” the district police chief said.
Action will be taken against anyone including the leader’s wife if she is involved in circulating the video said the officer adding that no action is possible against those who have already deleted the video.
Section 67 of IT Act sentence the convict imprisonment up to three years with fine up to five lakhs on first conviction while in a second or subsequent conviction he may be punished with imprisonment up to five years and also with fine up to Rs. 10 lakh.
