Various tactics to deprive Wakf Board of the valuable property of Manikonda Jagir

Land dispute for Wakf land of Dargah Hussain Shah Wali Rh., admeasuring 1664 acres located in Manikonda Jagir had already started since 1969. In a writ petition, A.P. High Court had declared this property as Wakf land. Board of revenue was a party in that case. Nobody had gone to the court against this judgement. In the 1990’s, Govt. took possession of this property declaring it as Govt. land. From the year 2000 TDP Govt. divided this land into various segments and started allotting to various multinational companies and institutions of all India repute.

 

Wakf land treated as Govt. land

It is necessary to clarify here that at the time of allotment of this land to multinational companies, the status of it was shown as “Govt. land” because in the previous survey, by mistake this land was not entered as “Wakf land”. Wakf Board itself was unaware of it. After it came to know, Wakf Board issued a corrigendum. Wakf Board had made a claim over this property when the Govt. was allotting this land to LANCO Hills, Emaar Properties etc., during Congress regime, Wakf Board had started presenting its claim but it was set aside.

 

Congress Cheated Muslims

The role of the Congress Govt. was disgraceful right from the beginning. It indulged in various types of conspiracies. Till the end it left no stone unturned to deprive Wakf Board of this valuable property Congress Govt. tried to suppress every voice which was raised in favour of this property. When the Govt. led by Dr. Y.S. Rajashekhar Reddy sensed that then Wakf Minister Mr. Mohammed Fareeduddin, is not dancing to its tunes, his portfolio was taken away from him and it was allotted to MR. Mohammed Ali Shabbir.

 

Officers Supporting Wakf Board transferred

Mr. Shafeequz Zaman and Ms. Chaya Ratan, Principal Secretaries were transferred from the Dept. of Minorities when they were supporting the cause of Wakf Board. They were taking bold decisions in favour of Wakf Board. By exerting pressure on Mr. Mohammed Ali Rafath, an attempt was made to weaken the case of Wakf Board. He was transferred. Right from the beginning, the Govt. attempted conspiracies. The affidavit submitted by Wakf Board was changed. At that time there was no elected Wakf board. The Govt. forced the Wakf Board through its appointed special officers and CEO’s. Govt. exhibited worst kind of communalism when its Chief Secretary contended that when Govt. of India can take over the land pertaining to Babri Masjid, it has the right to seize Wakf land also.

Govt. caused the submission of an affidavit through the CEO of Wakf Board that it is prepared to accept compensation which was like weakening Wakf Board’s case.

 

Defeat for Soli Sorabji and Victory for Shafeeq Mohajir

Govt. had also engaged famous lawyer Soli Sorabji. Then the Chief Justice Mr. Singhvi’s Division Bench exerted pressure on the standing counsel of Wakf Board and he was not given a chance to represent the case properly. When Wakf Board commissioned the services of Mr. Shafeeq Ur Rahman Mohajir, the case of Wakf Board got stronger. When the Managing committee of Dargah Hussain Shahi Wali submitted a petition to Wakf Tribunal for injuction orders. The present chairman of Wakf Board, without caring for the hary fees of Mr. Shafeeq Mohajir, the appointed him to represent Wakf Board. After his appointment LANCO Hills and other multinational companies got panicky. Attempts were made to dislodge him from the legal battle. When Wakf Tribunal issued injuction orders, the multinational companies filed CRP’s in High Court for which Mr. Mohajir raised objection and submitted a petition to Chief Justice for ordering CBI to probe.

Soli Sorabji lost this case whereas Shafeeq Mohajir emerged victorioius.

 

LANCO loses the case

The judge hearing this case entrusted this case to Chief Justice. The Chief Justice referred the case to single bench of Justice Ghulam Ahmed. When the multinational companies sensed that the judgment is not going to be in their favour, they requested the judge to postpone hearing till after the vacation. They said that they would request the Govt. to allot some other land in lieu of this Wakf Land.

After the retirement of Chief Justice Kukroo, the case was referred to the Division bench of Justice Kanta Rao and Justice V.V.S. Rao. It may be noted here that Govt. allotted 108 acres of land to LANCO Hills at the rate of Rs. 427 crore in the agreement of APII DC this amount was shown as Rs. 60 lakh towards the cost of land and Rs. 3.67 crore towards development charges.

This was deliberate attempt. The intention was that in case a claim is made by Wakf Board, only the cost of land could be reimbursed to it which was Rs. 60 lakh per acre.

After launching LANCO hills project, its owners sold out all the sites within 39 houses and collected huge amounts. They started constructing buildings with these amounts. They started selling space at the rate of Rs. 4,500 to Rs. 5,900 per Sq.ft. whereas the total cost of this project was shown as Rs. 5,500 crore. On completion of the project, the total profit will Rs. 10,000 crore. In this way LANCO Hills owner Rajagopal lost the case.
