The rape accused gets bail from Madras High Court to negotiate with victim

V. Mohan raped a minor girl who become pregnant and gave birth to a child. Mahila Court in Cuddalore in 2002 imposed a fine of Rs. 2 lakh besides giving 7 years imprisonment.

The accused applied for bail which was granted by the judge saying that Islam, Hinduism and Christianity make a provision for resolving disputes through mediation which generally result in happy conclusion.

The judge remarked that the accused should be given an opportunity to negotiate with the victim as a free man to arrive at a positive solution.

The judge further pointed out that the rape victim has now become mother of a child. She is nobody’s wife and she is an unwed mother. In this case the girl and her child are the victims of circumstances. They should find a redressal to lead a peaceful life.

Justice Devadass ordered the accused to deposit a fine of Re. 1 lakh as a fixed deposit in a local bank in the victim’s bank account.
