Hyderabad, September 27: A.P. High Court vacated the two year old stay on utilizing Govt. funds for repairs to Mosques and graveyards. This respite entitles A.P. State Wakf Board to receive grants from Govt. for maintenance of graveyards and repairs to mosques. Prior to General elections of 2009, Dr. T. Hanuman and others had challenged the orders giving grants for repairs to mosques and graveyards. This was challenged under article 27 of Constitution of India, wherein incurring expenditure by Govt. for religious purposes is prohibited. Division bench of A.P. High Court consisting Chief Justice Mr. Nisar Ahmed Kakroo and Mr. Justice Vilas Afzalpur heard petition NO. 20972 of 2009 and two others vacated the stay.
Secretary of Dept. of Minorities Welfare Mr. Mohammed Ali Rafath, IAS taking special interest for getting the obstacles removed in stay by commissioning the services of senior lawyers Mr. J. Sudheer and standing counsel of A.P. State Wakf Board Mr. Mohammed Abdul Muqueet. By eviction of stay order, Wakf Board is now in a position to utilize grants for the repairs and maintenance of mosques, graveyards etc., receiving grants from State Govt. was also abandoned on account of this stay order.
The high courts’ order removed the obstacles in getting grants from the Govt. of A.P. for religious purposes.
