School asked to explain excessive late fees penalty

New Delhi, October 08: The Delhi High Court Thursday sought an explanation from the capital’s Ramjas School and the Delhi government for charging an excessive late fees fine from students.

Justice Geeta Mittal issued notice to Ramjas School, Anand Parbat, for not abiding by the rules which say a fine of five paise only per day can be charged from a student for late payment of fees.

Ramjas was charging Rs.10 to Rs.200 per day as fine.

The court asked the school and the Delhi government to respond by Feb 13, 2010, the next date of hearing in the case.

The court was hearing the petition filed by Rajesh Yadav, whose daughter studied in Ramjas School and another child is still studying, and Social Jurists, an NGO working in the field of education, through advocate Ashok Agarwal who contended that charging such a high fine is totally illegal and tantamount to commercialisation of education.

According to the petition, Ramjas was charging Rs.10 per day as penalty for late payment of fees which is a clear violation of Delhi Schools Education rules which prescribe that the fine for late payment of fees shall be just five paise per day.

“Almost all the public schools in Delhi are charging from the parents, fines at the rates ranging from Rs.10 to Rs.200 per day for late payment of fees which is utter violation of the provisions of Delhi School Education Act and the rules made there under,” Agarwal submitted before the bench.

Yadav has also demanded that all his late payment fees fines paid by him over these years should be refunded to him.
