New Delhi, April 20: The Supreme Court has held that the mere fact that a dacoity was committed 30 years ago cannot be a mitiagating factor to take a lenient view of such serious offences.
A bench of Justices P Sathasivam and R M Lodha upheld the five years imprisonment imposed on three dacoits Ram Babu, Man Singh and Jagdish Upadhyay who had challenged the five- year sentence imposed by a sessions court.
“It was submitted by learned counsel for the appellants that the incident had taken place in 1980 and the appellants have already undergone half the period of the sentence and their sentence be reduced to already undergone. We are not impressed by this submission.
