Commenting upon the news published in newspapers regarding Supreme Court’s decision on fatwas and darul Qaza, Assistant general secretary All India Muslim Personal Law Board Mr. Mohammed Abdur Raheem Qureshi said that the court has not pronounced it judgment rather it has reserved its order.
However judge’s remark during the arguments indicates that Supreme Court will dismiss the PIL filed by an advocate Vishwa Lochan Madan challenging the constitutional validity of Shariat courts for allegedly running a parallel judicial system in the country. Holding that it’s a matter of choice for the people to accept fatwa or not, the apex court said running of institutions like Darul Qaza and Darul-Iftaa is a religious issue and the courts should interfere only when someone’s rights are violated by their decision. “We can protect people who are subjected to suffering due to this. If somebody forces them on you, then we can protect you,”
Mr. Abdur Raheem Quraishi said the proceedings of the Supreme Court and the trends came to the fore during arguments generate hope that Supreme Court will accept All India Muslim Personal Law Board’s stand and order dismissal of the writ petition.
