SC refers SLP by OMC to Forest Bench

New Delhi, November 16: The Supreme Court on Monday referred to the Forest Bench the special leave petition filed by Obulapuram Mining Company Pvt Ltd.

The company challenging the order of the Andhra Pradesh High Court dated July 2, 2010, averred that the apex court had on May 10, 2010 permitted it to resume mining operations in the undisputed areas. However, the Andhra Pradesh government declined to grant mineral dispatch/transit passes for transportation of iron ore mined / extracted.

Aggrieved by this, the petitioner moved the High Court by way of a writ petition, but the High Court declined to exercise its jurisdiction as the main case is still pending in the apex court, the company stated.

At this, a Bench comprising chief justice S H Kapadia, justice K S Panicker Radhakrishnan and justice Swatanter Kumar issued directions to post the matter before the Forest Bench.
