New Delhi, September 10: The Supreme Court today dismissed the petition of don Abu Salem challenging his trial for offences other than those mentioned in the extradition agreement.
Salem was extradited from Portugal and the government had given an undertaking that he will not be given capital punishment.
Dismissing his appeal, a bench comprising Justices P Sathasivam and A K Ganguly ruled that the petitioner can be tried for lesser offences and such a course does not involve any breech of terms of extradition agreement/treaty.
With today’s judgement, Salem can now be tried for the offences which are less serious as compared to those for which his custody was handed over to the government.
