SC lays down conditions for extradition

New Delhi, August 10: The Supreme Court hearing a matter has laid parameters to be by the law enforcement agencies while permitting extradition of citizens to other countries.

The apex court laid down two preconditions for it: Firstly, that the offence should be counted as an offence by Indian Law as well. Secondly, the person for extradition must be liable to be arrested in India either under any law relating to extradition.

Further the apex court observed clarifying it s position on extradition: “Such an arrest can be affected only pursuant to a warrant issued by the Magistrate in view of Sections 6, 16 and 34B of the Act or an arrest warrant issued by a foreign country and endorsed by the Central Government under Section 15 of the Act.”
