New Delhi: The Supreme Court on Monday agreed to keep pending the matter of the appointment of Justice Akil Kureshi till the Centre notifies the former’s appointment after hearing the submission on the petition filed by the Gujarat Advocates Association.
The Supreme Court Collegium has already recommended Justice Kureshi’s appointment as the Chief Justice of Tripura High Court.
The apex court observed that the matter in connection with appointment and transfer goes to the roots of the administration of justice and interference in it.
“Judicial review is severely restricted. Interference in system of administration of justice does not augur well for the institution”, Chief Justice Ranjan Gogoi said.
The court also noted that the Collegium had revised its recommendations on the matter and, thereafter, put it up on the website.
The court also accepted the submission made by the senior counsel appearing for the Gujarat lawyers’ association, which has sought that the court keep the matter pending till the Centre decides on the issue.
“We also like put on record registry to list the matter after government acts on the Collegium decision”, the court observed.
