New Delhi, November 12: The Supreme Court has acquitted a man of the charge of abetment of his wife’s suicide because it happened three months after he brought home his “second wife”.
The apex court said a person can be convicted for abettment to suicide under IPC Section 306 only if there is direct or indirect proof to establish the charge that the accused had by his actions instigated the victim to take the extreme step.
A bench of Justices Mukundakam Sharma and R M Lodha took the view that though the accused Amalendu Pal of Kolkata had brought home his “second wife” Anita much to the chagrin of his wife Deepika who three months later committed suicide by hanging, the husband cannot convicted for the suicide.
