SC acquits 5 life convicts, rejects dying declaration

New Delhi, June 21: Holding that a person in an intoxicated state cannot write a dying declaration with precision, the Supreme Court has acquitted five persons convicted to life imprisonment in a murder case.

A bench of Justices Deepak Verma and K S Radhakrishnan quashed the concurrent judgements of the sessions court of Bhiwani in Haryana and Punjab and Haryana High Court that the accused had forcibly administered liquor laced with poison to the deceased Vijay.

The apex court in a judgement said the prosection’s theory that the deceased Vijay had written a dying declaration cannot be believed as it was neither possible for a person in such an intoxicated state to write such a note nor the accused would have allowed him to write it.
