In a major relief to former chief minister and Tamil Nadu Governor K Rosaiah, the Andhra Pradesh High Court on Friday stayed an order of a designated ACB court which directed him to appear before it on August 2 in connection with the Ameerpet land allotment case.
The court while staying the ACB court orders, observed that the orders were in violation of Article 361 of the Constitution. The court said that it was against the Constitution to issue summons to a state governor.
Earlier, the ACB court issued summons to Rosaiah on June 18 and asked him to appear before the court on August 2 as he was an accused under Section 409 (criminal breach of trust) of IPC and under the Prevention of Corruption Act.
challenging the orders, Rosaiah filed a petition in the High Court seeking quashing of summons.
The court summoned Rosaiah on a petition filed by T Sri Ranga Rao, counsel for Mohan Lal, that the authorities handed over a land measuring over nine acres worth about Rs 500 crore at Ameerpet to G A Naidu and others in an unlawful manner. (INN)
