Rapist father, brother from Hyderabad move SC

New Delhi, May 22: Syed Isaaq, 52, alias Aijaz, and his son Syed Shahabuddin, 30, alias Ilyas, who were sentenced to life imprisonment for repeatedly raping Isaaq’s 14-year-old minor daughter, have approached the Supreme Court challenging the City Sessions and AP High Court verdicts. The case of the father-son rapists, who were residents of Hafeezbabanagar in Kanchanbagh, had come to light in 2005 and they were sentenced to life 10 months back.

The victim’s brother and accused, Shahabuddin, had impregnated her and DNA tests of the aborted foetus had proved that he was the biological father of the girl. The girl has said in her statement that her father and brother had repeatedly raped her for six months in their house when her mother was away. The two are now claiming that they had been falsely implicated and the conviction was erroneous.

Counsel for the accused, Ms G. Madhavi, said that DNA evidence should not be the basis for conviction as the girl had turned hostile later during the trial and had only named the father. The DNA evidence, meanwhile, was only against Shahabuddin. There was no DNA evidence against Isaaq.
