How Rajasthan govt’s ordinance against Indian constitution, Sachin Pilot explains

The recent move of Rajasthan government passing an ordinance ‘protecting the corrupt’ has been severely criticised by media as well as the opposition.

The ordinance seeks protection of serving/former judges, magistrates and public servants from being probed without its prior sanction. The ordinance also seeks to bar the media from reporting on accusations till the sanction is obtained.

“No magistrate shall order an investigation nor will any investigation be conducted against a person, who is or was a judge or a magistrate or a public servant,” it reads, providing 180 days of immunity to the officers.

Sachin Pilot, President Rajasthan Pradesh Congress Committee, explains how this ordinance is against the Indian constitution. He says that the bill is illegal, inappropriate, immoral and unconstitutional.

Vasundhara Raje should reason out the necessity to pass this ordinance, he adds. Pilot, who had moved to the Rajasthan High court, says: “Article 14 and Article 19 of our constitution is against what the bill stands for.”

“We have told the court that the ordinance itself is illegal and the court must strike it down and the court today itself has actually issued notices to the government, regarding this ordinance,” said Pilot in an interview on Saturday with The Wire.
