Mumbai, March 13: Public prosecutor Ujjwal Nikam on Friday sought to counter the argument of Kasab’s lawyer in cross-examination that 13 eye witnesses had not attended the parade to identify his client, saying they had identified him in court. Nikam also rebutted Kasab’s claim that 26/11 pictures are fake.
He said it is not necessary for eyewitness to recognise the accused in the identification parade only. They can identify in the court also. Identification in the court is considered a direct evidence as witnesses recognise the accused on the basis of their memory, the prosecutor said.
These 13 eyewitnesses had identified Kasab in the court when they came to tender evidence in the 26/11 case.
However, he said, nine other witnesses had recognised the gunman in the identification parade.
As regards the taxi blast at suburban Vile Parle, Nikam argued that the prosecution’s case is based on circumstantial evidence.
He said Kasab had admitted before a magistrate that he had planted a bomb in a taxi while getting down at Mumbai Chhatrapati Shivaji Terminus.
However, in his guilt plea before the trial court later, Kasab denied having planted the bomb, saying it was done by his accomplice Abu Ismael.
Kasab sat in the dock on a bench along with the two other accused. He had yesterday complained of low blood pressure. Today, however, he did not complain about his health.
