New Delhi: Several Political parties have submitted a notice of the impeachment of CJI Dipak Mishra to the vice-President today after the Apex Court had dismissed the independent probe plea into the death of CBI Judge BH Loya.
As many as 64 MPs from Cong, NCP, CPM, CPI, SP, BSP and Muslim League have today signed the impeachment notice proceedings against CJI.
Kapil Sibal, Senior Congress leader said the notice mentions five grounds of misbehavior for the CJI’s impeachment.
“Since CJI Dipak Mishra come, questions have been raised about his conduct. It showed in the January 12 press conference of four judges of Supreme Court. One concern of the four judges was memorandum of procedure was being unsettled,” said Sibal, referring to the press conference called in by Apex Court’s four most senior Judges.
“When the judges of the Supreme Court themselves believe that the judiciary’s independence is at threat, alluding to the functioning of the office of the CJI, should the nation stand still and do nothing”, asks Sibal.
He further went on saying that, “We wish this day had never come in the fabric of our constitutional framework. Since the day he (Dipak Misra) was appointed as CJI there have been questions raised in the manner in which he has dealt with certain cases,” and “Impeachment is the only recourse to save the judiciary.”
The motion to impeach CJI was first suggested in January after four most senior SC Judges held a press conference against deciding on cases.
Congress party too slammed SC verdict on denying an independent investigation of Loya’s death and said it as a “sad letter day”.
Party Chief Rahul Gandhi today told that the nation will not allow forget Judge’s Loya’s death.
Taking to Twitter, Rahul said, ” There is no hope left, everything is managed’ say Judge Loya’s family. I want to tell them, there is hope. There is hope because millions of Indians can see the truth. India will not allow Judge Loya to be forgotten.”
The unexpected death of Judge Loya while hearing the fake Sohrabuddin case has disturbed many citizens who are now questioning Justice in the nation.
Congress Spokesperson RS Surjewala while speaking to media said, “It is a sad letter day in India’s history. The suspicious circumstances in which Loya died, was a matter of deep concern for those who have faith in the judiciary. The copy of the entire judgment is not yet available. But there are still questions before those who believe in the judiciary.”
Criticizing the apex court’s verdict he said the case’s criminality cannot be decided unless there is a proper probe into the crime and no such probe has ever taken place in Judge Loya’s death.
The SC yesterday observed that the plea to probe the judge’s death was “bereft of any truth”, and an attempt “to malign the judiciary”.
It also maintained that judge Loya died a natural death and there was no doubt about the fact.
CBI Judge Loya was hearing the high-profile case of Soharabuddin fake encounter case in which BJP President Amit Shah was among the accused when abruptly died of a heart attack.
