New Delhi, August 05: Terming the offence as “abominable, inhuman and barbaric”, a trial court has sentenced a man to 10 years rigorous imprisonment for kidnapping and raping a five-year-old girl. The court convicted the 20-year-old man, a resident of Dabri in south-west Delhi, after the victim and her 7-year-old brother identified him as the perpetrator of the crime.
Holding Nashrulla guilty of rape, Additional Sessions Judge Mamta Tayal said, “The convict committed an abominable, inhuman and barbaric act of rape on a vulnerable child of five years, thereby violating and traumatizing her for entire life.” The court refused to show any leniency to the youth, saying his “dehumanizing” act has made the child undergo immense physical pain and agony.
“Sexual violence, apart from being a dehumanizing act is also an unlawful intrusion of the right to privacy and sanctity of a female. It is a serious blow to her supreme honour and offends her self esteem and dignity,” ASJ Tayal said while imposing a fine of Rs 7,000 on the convict.
The judge also noted that there was a human bite mark on Nashrulla’s right arm caused by the victim when the latter had tried to escape from the former’s clutches, and the accused was unable to explain about the mark in the court.
The incident happened on September 14, 2009, when Nashrulla had lured the child to a nearby ridge near her house at Bidapur in Dabri on pretext of giving her sweets. The prosecution said that when the victim was playing with her brother and other children in the evening near her house, Nashrulla came and gave her a toffee and took her and her brother along with him on the pretext of giving them more goodies. The prosecution said after walking some distance, Nashrulla threatened the victim’s minor brother and asked him to go back or else he would kill him. He then took the girl to a secluded place.
When the boy returned home, he told his parents about the incident and the matter was reported to the police. Nashrulla had fled after raping the child. She was brought back home the next morning by some unknown persons, who found her bleeding and bruised all over.
A case was registered at Bindapur police station by the victim’s father, Niranjan Shah. Nashrulla was arrested after 20 days of the incident.
