New Delhi, April 29: A fresh petition was submitted before a special court on Thursday in connection with the 2G spectrum.
Private applicant Dharmender Panday submitted that Nira Radia and Ratan Tata should be made accused and not witness. He noted, “The CBI had overlooked the role of Nira Radia and Tata in the granting of the licence to Tata Teleservices in terms of clear violation of policy and procedure.”
Special CBI Judge OP Saini posted the matter for further hearing on May 2.
The petitioner argued, “The CBI had registered the case in the spectrum matter in 2009 itself but there was no progress till the time the alleged phone taps among several personalities were published and put on the internet.”
The wire taps included conversations between Tata and Radia. Based on the transcripts that were published, the petitioner further alleged that Radia used her position and power in distribution of portfolios in the Council of Ministers.
According to Thursday’s petition, “Much before filing of chargesheet, the CBI had, during the course of investigation, information about the violation in the granting of the licences of Tata Tele under pressure and the active role played by Radia.”
The application further said, “The court has power to direct the investigating agency (CBI) for further enquiry to investigate the role of above named persons as per the law in terms of documents.”
