Families in Valley has approached the Jammu and Kashmir High Court to seek custody of the two minors detained under stringent Public Safety Act (PSA).
As per reports published in The Indian Express, the Srinagar wing of J&K High Court has ordered an inquiry following the habeas corpus petition filed by the kin of a detainee who claims he is a 14-year-old minor boy and was detained under the PSA.
A single bench of the HC comprising Justice Ali Mohammed Magrey responds to the plea and directs the Registrar to ascertain the age of the detainee and file its reply within 10 days.
Hearing another habeas corpus petition, another single bench of Justice Sanjeev Kumar on Tuesday directed the State to file its counter affidavit in light of the concerned matter and revert to the court on October 1.
While passin the order, Justice Kumar, states, “Notice accepted by learned Sr. AAG. He shall file counter affidavit by next date of hearing. The issue raised by the petitioner in this petition whether the petitioner-detenu is a minor and, therefore, is required to be treated as Juvenile shall also be addressed in the counter /reply affidavit.”
“The petitioner has already placed on record the marks card which indicates date of birth of the detenu as 15.03.2003. District Magistrate concerned to look into this aspect specifically and revert to this Court on the next date of hearing,” the order states.
