Ahmedabad, August 12: Senior IPS officer Kuldeep Sharma, facing murder charges in a 26-year-old encounter in Kutch district, today approached the Gujarat High Court seeking quashing of the FIR filed against him by the state CID.
Sharma, in his petition, contented that all charges against him were false.
He said the alleged incident had taken place in 1984, following which an FIR was registered then, in which he was not included as an accused.
There cannot be two separate FIRs for an incident which had same facts and circumstances, he said adding the complaint against him has been lodged with a malafide intention.
The 1976 batch IPS officer further contended that since the case is 26-years old, witnesses and documents in the matter would not be available which could cause prejudice to his defense. Hence, the FIR needs to be quashed, his petition said.
