Info Line case: HC restrains police from using force

Mumbai, April 18: The Bombay High Court has directed the city police not to take any coercive action against top offices of India Info Line Limited in a case of cheating, if police are going to file a chargesheet in the lower court.

“The police are directed to file its report. If the report is in the form of a chargesheet, police will not take coercive action against the accused. The accused will be given one week’s notice before filing of the hargesheet so that they may seek appropriate relief,” Justice J H Bhatia ordered last week.

An FIR was lodged against India Info Line’s chairman Nirmal Jain and director Mukesh Kumar Singh in September 2009 for allegedly cheating Ensemble Infrastructure of Rs four crore.

India Info Line approached the High Court seeking quashing of FIR. City police last week informed the court that investigation was over.

According to the complaint, Ensemble had been awarded a contract of Rs 8 crore in June 2008 to execute interior changes for India Info Line’s office at the Indiabulls Center in central Mumbai.

“As per the contract, India Info Line was required to pay an advance of 20 per cent of the contract value (Rs 1.63 crore) and further payments were to be made later. The company however paid us Rs 77 lakh only,” the complaint alleges.

India Info Line, while refuting the allegations, says that the contract was terminated due to Ensemble’s poor and slow work.
