A Division Bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice G. Rohini of the AP High Court on Monday issued notices to the Chief Election Commissioner, MIM and its MLA Akbaruddin Owaisi on a petition seeking to declare the MIM as an anti-national party and debar it from contesting any polls in future.
The Bench was dealing with a petition by Sunkari Janardhan Goud of the city stating that the EC and the Chief Electoral Officer rejected his complaint seeking action against the party and its MLA Akbaruddin Owaisi for the MLA’s alleged hate speech in Adilabad and Nizamabad.
The petitioner contended that the action of the EC in rejecting his complaint was contrary to the provisions of The Representation of People Act, 1951 and amendments made thereto from time to time to the Act and violation of Article 14 of the Constitution.
