HC suspends Mohammed bin Saleh Wahlan’s sentence in Chandrayangutta attack case

Hyderabad: The High Court granted interim suspension of sentence of Mohammed Bin Saleh Wahlan accused No. 12 in Chandrayangutta attack case. He was convicted in case of attempt to kill MIM MLA Akbaruddin Owaisi.

While dealing with an application moved by Wahlan seeking suspension of the sentence of 10 years imprisonment awarded by the trial court, Justice T. Sunil Chowdary allowed him to continue on bail.

It must be recalled that Hyderabad police had lodged a case against Mohammed Bin Omer Yafai better known as Mohammed Pahelwan and 13 others in connection with the alleged attack on the MIM MLA Akberuddin Owaisi, on April 30, 2011, in Barkas area of old city of Hyderabad. After trial, Additional Metropolitan Sessions Judge for Trial of Communal Offence Cases-cum-VII Additional Metropolitan Sessions Judge at Hyderabad had acquitted 10 accused, including Mohammed Pahelwan, but convicted four accused Hasan bin Omer Yafai, Abdullah Yafai, Awad Yafai and Mohammed Wahlan and sentenced them to 10 years in prison on June 29, 2017. Challenging the sentence, the four convicts appealed before the High Court.

Justice T Sunil Chaudhry suspended sentence of Mohammed Wahlan while the hearing of other three convicts is pending. Justice T Sunil Chawdary pronounced the judgment stating that Mohammed Wahlan will be released on bail after furnishing personal release bond of Rs. 50000 and two sureties.

Counsel for the petitioner B G Rajeshwar while seeking suspension of his client’s sentence argued that the petitioner was on bail when the trial court had awarded punishment to four accused, where as three of them were in prison. He further told the court that his client is not present in Chandrayangutta attack case video and he should be granted bail till complete hearing of his case.
