HC summons CEO to clarify on poll process

Admitting a petition challenging the Constitutional validity of holding of general elections in the State amidst process of bifurcation, a Division Bench of the High Court directed State Chief Electoral Officer Banwar Lal to appear before it to clarify the position.
In his petition, Pamarru MLA TY Das has questioned the validity of conducting elections in the united State when the process of bifurcation was on and how and on what basis legislators would be distributed to two new States. The petitioner further submitted to the court that the term of the present Assembly has not been completed and the election process even before completion of the bifurcation process was unconstitutional. He urged the court to grant a stay till the process of division of the State was completed.
Hearing the petitioner’s arguments, the Division Bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice Sanjay Kumar directed State Chief Electoral Officer Banwar Lal to appear before it and submit a report with all details on the issue and adjourned the hearing on the petition to Thursday.
