HC sets aside Shiv Sena MLA’s election

Mumbai, February 24: The Bombay High Court has set aside the election of a Shiv Sena MLA from Malegaon, Dadaji Dagdu Bhuse, as he had failed to disclose details about pending criminal cases against him along with nomination papers.

Justice Roshan Dalvi, while setting aside Bhuse’s election, observed that non-disclosure of details about pending criminal cases amounted to an election malpractice.

The court was hearing the petition filed by Bhuse’s rival, Arjundada. According to the petition, Bhuse had only mentioned the sections applied in all the 21 criminal cases filed against him but had not given more details.

“Merely mentioning the sections applied in each case is not sufficient compliance of rule 4 A of the Conduct of Election Rules,” the petition stated.

The court yesterday accepted the arguments and set aside Bhuse’s election. It has however given him four weeks to file appeal in the Supreme Court.
