HC ruled out the authority of CEO of State Wakf board

The Hyderabad High Court has ruled that the chief executive officer of the State Wakf Board has no authority to pass an eviction order as per the new Wakf Act which came into force on November 1, 2013.

The wakf board has now decided to crack down on the encroaches, some of whom have been illegally occupying its land for decades.

While listening to a petition filed by Naga Prasad Rao challenging an order issued on September 16, 2014 to vacate the premises on the ground that he had encroached upon the land belonging to a Wakf land, Justice Nooty Ramamohana Rao ruled out the authority of CEO of the state wakf board.

“The CEO is competent to conduct an inquiry by issuing notice to the encroacher after considering the objections and if the CEO is satisfied that the property in question is Wakf property and that there has been an encroachment, he may make an application for grant of order of eviction,” the judge ordered.
