Hyderabad, February 26: A division bench of the AP High Court comprising justice V. Eshwariah and justice V Suri Appa Rao on Friday overruled objections on whether a public interest writ petition can be filed for an enquiry into the Emaar scam before the High Court.
A letter was addressed to the chief justice by Congress MLA Shanker Rao seeking a full fledged enquiry into the scam. Emaar raised a preliminary objection contending that the author of the letter, now a minister, could not file the present petition as he was not incapacitated and it was not a matter which required the indulgence of the court. Rejecting the petition, the bench speaking through justice V Eshwariah pointed out that the allegations were very serious in nature involving huge public funds and as such the court could not be stopped from hearing the matter on merit.
