Kochi, October 15: Kerala High court today lifted an attachment order passed by a lower court attaching moveable properties belonging to the office of the Director Army Recruitment office, Kozhikode.
The order was pased by Justice S Satishchandran while considering a petition filed by Director Recruitment, Ministry of Defence, Kozhikode, challenging the Oct 7, 2006 order of the Munsiff court there.
Earlier,the Munsiff court permitted P M Padmini Amma to recover her family pension due on account of the death of her husband, K Madhavan Nair, who was working at the office, with effect from January one, 2001. The order permitting execution of the earlier order was issued on May 25, 2007.
According to the petitioner, sect 28 of the Army Act prohibits such action by a civil court.
