The Madras High Court today dismissed a petition by the daughter of a Malaysian fugitive wanted by the Interpol alleging sexual assault by police personnel, including an IPS officer, after her father was arrested, and ordered her to pay a cost of Rs 10,000.
Justice C T Selvam dismissed the petition by Shyamala after recording the affidavit by DGP K Ramanujam on the criminal antecedents of her step-father Karunairaj alias Michael Soosai, who had been living in the country since 2003 after illegally entering it along with her.
Noting that Soosai’s statement recorded before a magistrate pursuant to his arrest in 2010 had no mention about the wrongdoings presently alleged by Syamala, the judge said, “This is most unnatural. The present complaints are sheer acts of vendetta and malice.”
Shyamala had sought a direction to register a case on her March 14, 2014 complaint alleging sexual assault by the police Officials of Coimbatore City including the then Commissioner C Cylendra Babu.
The Judge directed Shyamala to pay cost of Rs 10,000 to the Tamil Nadu State Legal Services Authority.
According to the prosecution, Soosai was involved in several cases of cheating and murder in Malaysia and in Tamil Nadu. To escape from cases pending against him in Malaysia, he created a forged death certificate mentioning that he had died on September 12, 2003.
This was disclosed by an October 19, 2005 Red Corner Notice issued by the Interpol, Malaysia.
He entered India without any valid travel documents in 2003 when Shyamala was 11 years and had been living with one Macha Kanthi alias Jayanthi, also an accused in the murder of a Malaysian national in December 2004 at Cheyyur in Kancheepuram District.
In the meantime, Coimbatore Police had also registered several cheating cases against the couple and arrested them in August 2010, following which Shyamala made sexual assault complaint against the police personnel.
