HC declines to quash SHRC proceedings against doctor

Chennai, January 18: Madras High Court today declined to quash proceedings initiated by State Human Rights Commission against a senior Tamil Nadu government doctor for allegedly seeking sexual favour from a woman colleague, and directed him to the raise the question of limitation before the SHRC.

A Ganesan, a deputy director of Health Services, has challenged the maintainability of the proceedings before the State Human Rights Commission (SHRC) on grounds of limitation that such complaint could not be entertained beyond one year.

Disposing of the matter, a bench comprising Chief Justice M Y Eqbal and Justice T S Sivagnanam directed the petitioner to file an objection on the question of limitation with SHRC which shall first decide the maintainability of the complaint by passing a reasoned order and thereafter proceed with the enquiry if it was found that the complaint was within time.
