HC confirms the committee of Mumtaz Yaruddowla Trust

Justice Vilas Afzulpurkar of A.P. High Court confirmed the new committee of Mumtaz Yaruddowla Trust consisting of Mr. Ghulam Yazdani, Advocate (President) and Mr. Mirza Khusro Ali Baig (Secretary) rejecting the claim of Mr. Ibrahim bin Abdullah Masquati.

This trust runs Mumtaz Degree and PG College besides running Mumtaz Engineering College and Asafia High School. Nawab Mahboob Alam Khan was made the honorary Secretary of the Trust. As per the Bye-Laws of the Trust, election of the Committee should be held once in two years. The committee headed by Mr. Ghulam Yazdani alleged that for the past 20 years no elections were held and Mr. Mahboob Alam Khan continued as self-styled Secretary. When it was demanded to hold elections, Mr. Mahboob Alam Khan did not listen. A meeting of the member of Mumtaz Yaruddowla Trust was held on 4th November 2013 and dismissed Mr. Mahboob Alam Khan from the post of Secretary and elected Mr. Mirza Khusro Ali Baigh in his place. The new committee took charge immediately. It also took control of the properties situated at Lakdikapul. The new committee consists of Mr. Ghulam Yazdani (President), Mr. Mirza Khusro Ali Baig (Secretary), Mr. Mahboob Alam Khan (former Secretary), Mr. Syed Sajjad Shahid, Ms. Anees Khan, Ms. Rehana Hasan, Mr. Khaja Moizuddin, Advocate and Mr. Shaik Anwar as members. The information relating to the constitution of new committee was also given to AP State Wakf Board which confirmed it in its meeting held on 17th November 2013. Mr. M.A. Ghaffar, CEO of Wakf Board issued orders in this regard.

Mr. Ibrahim Bin Abdullah Masquati approached A.P. High Court and challenged the formation of the new committee and requested two squash it. He contended that Mr. Khusro Ali Baig is not the member of Mumtaz Yaruddowla Trust and hence he cannot be the Secretary. Mr. Masquati declared himself as President and Mr. Zahid Ali Khan as its Vice President and said that this information was communicated to Wakf Board on 15th November and 29th November 2013.

Mr. Masquati in his petition number 38308/13 had made Wakf Board, Mr.Yazdani , Mr. Baig and the newly elected members as parties. Filing the counter affidavit, AP Wakf Board rejected the claim of Mr. Masquati and said that his election as President is itself wrong since no meeting of the member of the committee was held and no information was communicated to the members. As far as the case of Mr. Mirza Khusro Ali Baig’s election as Secretary is concerned, it may be noted that in the meeting of the committee of the said trust was held on 4th November 2013 in which 7 out of 8 members attended and the resolution was sent to Wakf Board which was accepted. AP High Court dismissed the petition filed by Mr. Masquati.
