HC asks Waqf panel to take up Lanco case

Hyderbad, February 25: The AP High Court on Thursday directed the State Waqf Tribunal (SWT) to take up the Lanco Hills Technology Park case in Manikonda village for hearing on February 28 and dispose of the same on merits in accordance with law.

The SWT on February 14 had passed an order in a petition filed by the managing committee of the Dargah Hazrath Hussain Shah Ali asking all the parties involved to maintain status quo in relation to the sale, alienation, transfer, mortgage, exchange and lease to the entire property in Manikonda Jagir admeasuring about 1600. Of this, LHTP possess 108.10 acre in Survey No. 201 of Manikonda village. Besides Lanco there are 16 other respondents in the case.

Mahmood Ali, counsel for LHTP, appearing before the bench of Justice Prakash Rao maintained that a vakalathnama was filed before the tribunal on February 14 and permission sought for filing the counter. The counter affidavit raising several questions was filed on February 15 which was not considered by the tribunal. It also did not concede to the request of advancing the date of hearing.

Justice Prakash Rao observed that the order impugned is only an ad interim without considering the petitioner’s case. Therefore, he said, it is desirable that the application should be disposed of at the earliest. The court then directed the Tribunal to hear and dispose of the same on February 28.
