New Delhi: The ordinance passed by Modi government against triple talaq in one sitting has raised several questions in the minds of experts. Noted advocate of Allahabad High Court Farman Ahmed Naqvi has raised some basic questions regarding the ordinance and declared it a decision taken keeping in view 2019 general elections.
As reported by Inquilab advocate Naqvi said the ordinance against triple talaq was passed in a haste due to which it will do more harm than good. Though the ordinance is against talaq-e-biddah in the entire ordinance there is no mention of what actually talaq-e-biddah is?
Mr Naqvi said there is a mention of talaq in section 3 and 4 of the ordinance but it did not clarify which talaq is it. He questioned if the case goes before magistrate how can he give judgment? How he can know which talaq is legal and which is illegal? If the government had passed the ordinance it should have made it clear which talaq is legal and which is illegal.
Advocate Naqvi told that this is dangerous that giving talaq per se has become illegal. Even if one is giving talaq in a legal manner, he will be a criminal in the eyes of court because there is no clarification in the ordinance.
