Hasty decision of Divorce and Qula shatter the families

(Siasat News) It is a joint decision of Muslim Ulema that every Muslim women has the right to demand Qula from her husband but unless the husband accepts her requests for separation, Qula will not be implemented. In such a case, the parties should approach an arbitrator for reconciliation or to take the help of the legal experts. These thoughts were expressed by noted Lawyer, Mr. Mohammed Osman Shaheed, Advocate at a meeting organized by All India Muslim front to consider the implications of the right to seek Qula and Divorce.

Addressing the gathering, he expressed his concern for the increasing number of divorce and Qula cases in Muslim society and told that the relatives of the bride register cases U/s 498-A, of trivial issues. In some cases women are getting divorce by pressurizing the husbands and their relatives which comes under divorce by force. In the eyes of law such divorce is illegal and if the woman remarries, its legal status will be complicated.

Mr. Osman Shaheed told that hasty decisions taken by wife and huband shatter the family and put children in miserable conditions.

Mufti Sadiq Mohiuddin Faheem, of Jamia Nizamia told that the Muslims should live the life under Islamic guidance. He further said that marriage is a legal contract and also a worship. Moulana Abdur Raof Hissami told that if Muslims follow Islamic Sharia, divorce or qula could be avoided. He advised the Muslims to approach the Muslim intellectuals and Ulema for conciliation. Mr. Mushtaq Malik told that some husbands behave cruelly with their wives. Mr. Syed Shah Noorul Haq Quadri, Advocate told that the right to seek Qula is subject to the approval of the husband. If it is violated it is against Islamic Sharia. Mr. Ghulam Mohammed, General Secretary proposed vote of thanks and presented the report of the association.
