Germany: Lawmakers to legalize “intersex”- third gender

Berlin: Germany’s top court has ruled this Wednesday favoring an appeal, that the lawmakers should legally recognize a “third Gender” from the birth in the country, making it the first European country to legalize “ intersex” as a gender other than the normal male and female gender.

The Federal Constitution Court has told that the current regulations on the civil status are discriminatory towards the third gender- intersex, adding that the lawmakers should pass a new regulation by the end of 2018 offering a new gender option-intersex in birth registers along with legalizing their rights.

The Federal Court’s ruling comes after an appeal was filed by an intersex plaintiff who moved to the court to legalize his rights.

Earlier the plaintiff’s appeal of the same was rejected ruling against a bid for gender change to “inter” or “various” in the birth register.

The intersex plaintiff was registered as a female, but a chromosome analysis found the plaintiff to be neither male nor female.

Intersex is a broad term of people who have sex traits, such as genitals or chromosomes, that does not entirely fit with the typical binary notion of male and female. These have features that are neither completely female nor completely male, or a combination or neither.

Countries like India Australia New Zealand and Nepal are the few countries to identify people as intersex on official documents.
