‘Fresh hymen tear’ seals man’s fate in rape case

Mumbai, June 18: Like Shiney Ahuja, Ramshankar Chaudhary had been charged with raping his employee. In his case too, medical reports showed that the 27-year-old owner of Sheetal Industries in Oshiwara had made “an attempt at forceful intercourse”. (Police said on Tuesday that medical reports of the domestic aid, who has accused that Shiney raped her on Sunday, confirmed forced vaginal intercourse.)

Last week, Chaudhary was sentenced by additional sessions judge SC Chandak to seven years rigorous imprisonment for raping his employee, Shefali (name changed). The victim, also aged 27, used to work as a gift packer for a salary of Rs 2,000 a month.

As per Shefali’s testimony before the court, she was waiting for a bus in Jogeshwari en route to work on February 16 last year. Chaudhary, who was passing by in an auto rickshaw, offered her lift. But instead of taking her to office, he took her to Kohinoor Cottage on Malad beach, and booked a room for an hour.

Shefali told the court that she pleaded with Chaudhary to let her go, saying that she was unmarried and he was like a brother to her. But he raped her. When the girl reached home, her mother noticed the blood stains on her clothes. Shefali was so scared that she didn’t lodge any complaint for two days.

Finally, when she reported the incident to Oshiwara police on February 18, Chaudhary was booked for abduction and rape.

The police seized Shefali’s clothes and the bedsheets from the room of Kohinoor Cottage. Additional public prosecutor Usha Jadhav examined 12 witnesses, including waiters and hotel staff, who testified that Chaudhary had gone there with the victim. Chaudhary, a married man, said in his defence that the sexual intercourse was consensual.

But medical evidence, given by a JJ Hospital doctor who had examined Shefali, sealed Chaudhary’s fate. He told the court that examinations showed “an attempt at forceful intercourse” by Chaudhary. According to the doctor, the hymen tear was just one or two days old.
